Depending on the nature of the accident, you can sue the park itself, the company that installed the park, or the manufacturer of the equipment. Every park has a responsibility to keep their premises safe, eliminate all expected/foreseeable risks, train and supervise their staff, as well as attempt to prevent injuries or death.
A common clause in the waiver may force you to go through arbitration, which helps the park to save their face by avoiding a public trial, but at least you could get financial compensation.
